This page explains how Modest Foundry (“FlickrVault”, “we”, “us”) handles copyright and how to report content you believe infringes your rights. It forms part of, and should be read together with, our Terms of Service.
1. FlickrVault does not host downloaded photos
FlickrVault backs up photos directly from Flickr to the user’s own device. Downloaded photos never pass through or get stored on our servers. Any photo you can find through FlickrVault is hosted by Flickr, not by us.
If your concern is a specific photo on Flickr, the fastest route is to report it to Flickr directly (see §6).
2. What you can report to us
Send us a notice if:
- content on our own website or marketing materials infringes your copyright; or
- you believe someone is using FlickrVault to infringe your work and you want us to act on the responsible account under our Terms (see Terms of Service §6 Acceptable use and §13 Termination).
3. How to send a copyright notice
Email [email protected] with the subject “Copyright notice” and include:
- Identification of your work — the copyrighted work you say has been infringed (for example, a link to the original).
- Identification of the material — what is infringing and where it appears (a URL on our site, or a clear description of the misuse).
- Your contact details — full name, email address, and postal address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and — under penalty of perjury where applicable — that you are the copyright owner or authorized to act on the owner’s behalf.
- Your physical or electronic signature.
Incomplete notices may delay our response.
4. What we do
We review valid notices and, where appropriate, remove infringing material from our own website and materials and/or suspend or terminate the account responsible. We aim to respond within a reasonable time. We may terminate the accounts of repeat infringers.
5. Counter-notice
If your content or account was affected because of a mistake or misidentification, you can send a counter-notice to the same address including: your contact details; identification of the material or account affected and, if applicable, where the material previously appeared; a statement, under penalty of perjury where applicable, that you have a good-faith belief it was affected by mistake; and your signature.
6. Reporting a photo to Flickr
Because photos are hosted on Flickr, a copyright problem with a specific photo is usually best raised with Flickr directly through their intellectual-property reporting process. See the Flickr Help Center for how to report copyright infringement to them.
